Kansas defends sign law on adult stores

WICHITA, Kan. – The Kansas attorney general’s office says state law restricting billboard signs by sexually oriented businesses is not unconstitutional.

Kansas Attorney General Stephen Six [pictured] defended the law Monday in a federal court documents responding to a lawsuit filed by the Lions Den Adult Superstore over its Abilene store. The suit argued the state violates the First Amendment.

Six’s office contended in its court response that the Lions Den expression is not entitled to First Amendment protection because it does not concern lawful activity.

The state also claimed the statute survives First Amendment scrutiny because it advances substantial governmental interests.
