from www.northcoastnow.com - The Lorain man who was accused of trying to blackmail Larry Flynt’s Hustler Club in Cleveland was sentenced Thursday in Cuyahoga County Common Pleas Court to a year of probation and ordered to pay $2,000 in fines.
Joseph Schwarz, 34, pleaded guilty in February to unauthorized use of property in exchange for prosecutors dropping additional charges of extortion and possession of criminal tools.
Brent English, Schwarz’s attorney, said his client wasn’t trying to blackmail the club, but rather was trying to help two women who worked there whom he felt hadn’t received fair treatment from their employer.
“There was inappropriate touching by clients and the club did nothing,” English said.
He said the charge to which Schwarz pled guilty stemmed from his use of a government computer for unauthorized purposes, not for an attempted extortion scheme.
Schwarz resigned from his job as a compliance officer with the U.S. Occupational Safety and Health Administration and forfeited his cell phone as part of the plea deal.
Prosecutors contended that Schwarz posed as a lawyer while demanding money from the club after falsely claiming he had video of customers doing drugs and performing illegal sex acts in the club.
Schwarz first contacted the club in June, prosecutors have said, and kept up that contact in the following weeks using his work and personal computers as well as his personal cell phone.
He was arrested in July by the FBI’s Violent Crimes Task Force when he arrived at a meeting during which he was supposed to be paid $10,000 by the club, which was cooperating with investigators.
English said his client never had any intention of keeping any money for himself.
