Gene sez: The better question to ask is there a model release. And, if there is, all the protestations that Paris and her family have offered are bullshit and Paris was complicit in its release. If there's no model release, then people can get sued. Nobody's getting sued. Or at least that we're aware of. And if there's no model release, and presumably no ID's, etc., the video is also illegal, isn't it, under the new 2257 regs and subject to prosecution.
