Preliminary hearing under way in ‘Cathouse’ case; Bunny Ranch’s Brooke Phillips Sought Coke

from www.newsok.com – Pregnant “Cathouse” star Brooke Phillips [pictured] ended up at the Oklahoma City drug house, where she, two other women and a drug dealer were killed, because she wanted to buy cocaine, according to testimony at a preliminary hearing today.

A friend, Jose Fernando Fierro, 32, testified Phillips called him about 2 a.m. Nov. 9, 2009. He said she wanted him to sell her cocaine. She also was having an argument with some man and asked Fierro to take her with him, according to the testimony.

He said he took her to the drug house. He said she used some lines of cocaine when he first arrived to get her and then again at the house

Phillips’ death attracted national attention because she was a prostitute featured on “Cathouse,” an HBO reality program about a legal Nevada brothel. She was 22 and on leave from the brothel because she was pregnant. She was living in Moore. Fierro said he met her years ago when she worked at an Oklahoma strip club. He said she later worked for him in his business, “Spanish Fly.” He described his business as arranging private parties for men.

The preliminary hearing is for David Allen Tyner, 29, a cage fighter from Locust Grove. He is facing six murder counts because Phillips and another victim were pregnant.

Tyner was a bodyguard for one victim, drug dealer Casey Mark Barrientos, according to the testimony today.

Fierro said Tyner came to the drug house the morning of Nov. 9, 2009, looking for Barrientos. He said Barrientos and two of the women eventually arrived and Phillips left a bedroom to talk to the women.

Fierro said he fled the bedroom and then the house through a garage when he heard gunshots. He said one of the bullets came through the bedroom door. He described diving under the garage door as it opened and falling down in a neighbor’s yard. He said he looked back to see Tyner chasing after him. He said Tyner told him to come back. He said he began running again, fleeing through back yards. He said at one point he ran into a horse. He said he eventually hid in a tree. He said he was wearing only jeans

Tyner is accused in the murder charge of shooting, stabbing and setting on fire the four adults. The bodies were found when firefighters responded to a fire in southwest Oklahoma City.

Killed were Barrientos, 32, of Oklahoma City; Jennifer Lynn Ermey, 25, of Edmond; Milagros Barrera, 22, of Mustang, and her unborn child; and Phillips and her unborn child.

Defense attorneys suggested today that Fierro actually is to blame for the deaths and is making up his account.

Fierro said he had some concerns about selling Phillips cocaine since she was pregnant but he said he did anyway because she told him she was going to get an abortion.

Another suspect in the deaths, Denny Edward Phillips, has not been charged. He has been in custody since April after a shootout with Tulsa police. An Oklahoma County judge is hearing the testimony to decide if prosecutors have sufficient evidence to order Tyner to trial. A decision is expected Friday.
