San Antonio Ordinance Goes Into Effect

Naked ladies are a thing of the past in San Antonio.

San Antonio- A federal judge has approved a settlement reached by strip clubs and the city of San Antonio over its human display ordinance.

In an order last week, U.S. District Judge Fred Biery dismissed a lawsuit, which strip clubs filed in 2003 to challenge the ordinance’s constitutionality.

The order comes after City Council approved the latest version of the ordinance on June 9. The 52-page ordinance bans nude dancing, lap dancing and small, poorly lighted or locked VIP rooms.

And, it requires strip club employees to get ID permit badges, which are good for one year and portable.

The law also requires entertainers – if topless – to be at least 3 feet from patrons. Because of the so-called 3-foot rule, new language was added to still allow tipping.

Now, customers either have to reach out and hand the tip to the dancer’s outstretched hand, or put the tip in a receptacle.

The ordinance takes effect 90 days from the day it was approved, and could start to be enforced by Sept. 9.

As of Thursday, the city had not received any applications for the required ID permit badges.
