from www.theprovince.com - Ashton Kutcher is suing mad over the latest release from porn company, Vivid Entertainment.

It looks like Kutcher's alleged mistress was so inspired by the actor that she has taken up an acting career of her own and is about to star in her new porn flick titled Brittney Jones Confidential.

According to TMZ, Kutcher is furious of the release of the tape claiming that they're using his name illegally to push the nudie flick.

The website reports that lawyers for the That 70's Show actor have sent off a letter to Vivid Entertainment head honcho, Steve Hirsch, claiming that they're specifically teed off at the press release, which states, "Ashton's fans will undoubtedly enjoy seeing what the star himself may have experienced."

Kutcher's lawyers are threatening to start a legal nightmare against the XXX company if they don't stop associating Kutcher with the new flick, claiming that the connection is infringing on Kutcher's "marketable celebrity identity value".

Hirsch told TMZ, “We received the letter late this afternoon and I immediately forwarded it to my attorney. We will respond accordingly."

from www.nydailynews.com - Ashton Kutcher may have denied having sex with alleged fling Brittney Jones, but now he has a problem related to her having sex with someone else.

The actor's lawyer fired off a strong letter Thursday to Vivid Entertainment, an adult film company that is marketing a Jones sex tape by connecting it to the Kutcher rumors.

Vivid sent out a press release this week announcing the explicit video, noting that "Ashton's fans will undoubtedly enjoy seeing what the star himself may have experienced."

In the letter, obtained by TMZ.com, Kutcher's attorney, Robert D. Offer, claims that line constitutes "trading on Mr. Kutcher's good name and reputation for a commercial purpose, and … attempting to misappropriate and convert the potential economic value in Mr. Kutcher's identity to your own advantage."

Offer rattles off a number of laws he believes Vivid is violating and argues that Kutcher "is entitled to recover damages and profits" since the company's "conduct has already caused, and will continue to cause, substantial damages" to the 32-year-old movie star.

The matter can be resolved if Vivid stops associating Kutcher's name with the tape.

Vivid's founder and co-chairman told TMZ, "We will respond accordingly."

Jones claimed, via Star magazine in September, that she slept with Kutcher at his home while wife Demi Moore, 48, was away. She later alleged that the couple have an open marriage.

Kutcher himself hasn't commented on the tape or the potential lawsuit, but he and Moore continue to put on a united front amidst the allegations.
