XXX Store owner arrested on felony charges

Texas- A Brazoria convenience store owner accused of selling sexually explicit DVDs to customers could face up to 10 years in prison and a $10,000 fine if found guilty of the charge, Brazoria County District Attorney Jeri Yenne said.

Brazoria police charged Sandipkumar Ghandi with obscene wholesale/promotion with deviant sex acts at 1:30 p.m. Thursday. Police seized two boxes of pornographic DVDs and several magazines from the store, K.N.S. Jiffy Mart at 204 E. San Bernard, during a raid Wednesday.

Ghandi was in police custody when he was charged Thursday.

The man was first arrested on a misdemeanor simple assault charge, when a woman, who was working at the store during the search, filed a complaint against Ghandi for unwanted sexual conduct.

Police questioned the man Wednesday night and obtained the second arrest warrant, Brazoria Police Officer Charles Webster said.

Ghandi was released from the Brazoria jail after posting bail Thursday. His bond amount was $20,000, Brazoria Police Department Communications Supervisor Jeri Beck said.

“I would not anticipate that out on bail there would not be any obscenities at the store,” Yenne said.

The store has remained open, and Brazoria police officers have checked the store daily, Beck said.

“The store is still operating. They just can’t sell the pornographic materials,” Beck said. “Once they do a raid, the officers go back and double check it.”

During the search, police found two large boxes filled with DVDs at the end of the cash register, and a sign posted at the other end of the store stated DVDs were available for $13.99.

Police filed for a search warrant after an undercover police officer was sold three pornographic DVDs on three trips to the store, Webster said. Police have been unable to serve an arrest warrant for another man, Bhupendra Patel, who the undercover officer said sold him the DVDs.

The DVDs clearly violated the Texas Penal Code on obscenity, which sets the standards for pornographic material, Yenne said. The code states people cannot wholesale pornographic material that includes any type of sexual intercourse.

“The bottom line is that the material has to violate the Penal Code, ” Yenne said.

This was not the first time sexual explicit material was solicited in a Brazoria County convenience store, Yenne said.

“In fact, that is where we usually encounter it,” Yenne said.
