ATLANTA (AP) – A federal appeals court has ruled that Hustler Magazine didn’t have the right to publish nude photographs of the wife of wrestler Chris Benoit, who killed the woman and his young son before committing suicide two years ago.
Nancy Benoit’s family filed a federal lawsuit against the Larry Flynt Publishing Group last year after the magazine published nude photographs of Benoit’s wife. The lawsuit claims that Nancy Benoit had asked the photographer to destroy the images.
A three-judge panel of the 11th U.S. Circuit Court of Appeals reversed a lower court’s ruling that deemed the pictures “newsworthy.” It said Benoit’s death was newsworthy, but the 20-year-old nude photographs of his wife were not.
