Illinois- A Wisconsin woman visiting Chicago this summer said she was using the bathroom at a downtown Ghirardelli Chocolate Company store when she noticed the lid of the trash can moving slightly.

Then she said she saw a man peeking through that lid, watching her.

A lawsuit recently filed in Cook County Circuit Court seeks millions from the chocolate company for the alleged invasion of privacy.

Lisa Stewart claims in the lawsuit that the men’s and women’s bathrooms at the store, 830 N. Michigan, shared a trash can, with a metal lid on each side of an adjoining wall.

She claims that a male employee bumped into her on her way into the bathroom, and after she went inside, her fiance watched as the employee went into the men’s restroom next to it.

The employee had earlier “tampered with the lid on the ladies’ bathroom receptacle so that he could view women who were using the toilet,” the lawsuit says.

As Stewart sat on the toilet, she “heard the noise of the metal lid on the trash receptacle being lifted,” then saw the employee peering in from the other side, according to the complaint.

When the employee realized Stewart saw him, he ran from the men’s bathroom, the suit says.

A check at the store Tuesday showed the bathrooms do share a wall, but not a trash can.

An employee declined to say whether the bathrooms have been remodeled, referring questions to a manager, who declined to comment.

Stewart claims she was humiliated, has since lost sleep, suffers from depression and fears going into public restrooms.

She claims Ghirardelli was negligent in building a bathroom with a shared trash receptacle.

A Ghirardelli spokesman did not return calls for comment, while Stewart’s attorney declined comment.
