from www.wane.com – A former teacher was sentenced to three years in prison with all but one suspended for having sexual activity with a 14-year-old boy in the fall of 2006.
Dawn Marie Schwartzengraber, 39, pleaded guilty to Class D felony sexual misconduct with a minor Feb. 1 in Steuben Superior Court. Four other counts, including a Class B felony sexual misconduct with a minor charge, was dismissed by Judge William Fee as part of a plea agreement between Schwartzengraber and the state, represented by special prosecutor Greg Kenner. Schwartzengraber is represented by Angola attorney Linda Wagoner.
Monday, on the day of her regularly scheduled pretrial conference, Wagoner filed a motion to dismiss the case. After a hearing in Fee’s chambers, the motion was denied and another pretrial conference was set for Tuesday morning.
Sentencing was at the discretion of Fee as part of the plea agreement. The maximum penalty for a Class D felony is a three-year prison term.
Schwartzengraber taught at Camden-Frontier High School in Camden, Mich., and her victim was her student, court documents said. The Steuben County case was an offshoot of a Michigan State Police investigation, which revealed that Schwartzengraber and the boy allegedly carried on a years-long relationship that included sexual activity on both sides of the state line as well as along Michigan and Indiana roadways.
Schwartzengraber has been suspended from her teaching position since November 2009, when the Camden-Frontier administration became aware of a pending criminal investigation in Michigan. Indiana allegations followed shortly thereafter.
