Cincinnati- Homemade porn queen Jennifer Dute ended her fight with the legal system Thursday when she pleaded guilty to misdemeanor counts of attempted pandering of obscenity and was sentenced to time behind bars she already has served on the case.
In a plea deal with prosecutors, Dute pleaded to two counts of attempted pandering, charges carrying a maximum of 12 months in jail.
Common Pleas Court Judge Norbert Nadel immediately sentenced her to 180 days in jail. Because Dute already served eight months on the charges when she was convicted — her conviction was overturned on appeal as she was serving her sentence — she walked out of the courtroom today a free woman.
Dute, 34, was convicted in 2002 of selling her homemade pornography movies, shot by her husband, in Hamilton County, a violation of an earlier plea deal she entered into to avoid prison time.
In 1999, Dute was charged with pandering obscenity, but the charges against her were dropped when she allowed her company to plead guilty and pay a $2,500 fine and she agreed to never sell her videos again in Hamilton County.
As a condition of her 2002 sentence, Dute also gave ownership of www.simonleis.com to Hamilton County.
Dute writes to Adultfyi: Unfortunately, my fight has ended—the case is over—with the judge I had been rolled to, it was way too risky to chance anything—he would have and could have done whatever the hell he pleased and let the court of appeals sort it out—like the previous judge did…meanwhile I would be in jail/prison for another 4 1/2 months (assuming worst case scenario and a guilty verdict).
I plead to 2 counts of attempted pandering—misdemeanors—180 days TIME SERVED. Yeah, I did 240 damn days….I am not happy with the way all of this has ended, but I did not have a choice. People think it is about choice, but it isn’t. Then again, I had a choice of getting screwed bigtime again, or getting screwed bigger time again. Not much of a choice is it!
I have much bigger and better things to do with my time…..I have a 2 1/2 year old son and twin almost 7 month old sons…..and they along with my husband Allan are THE MOST important in my life. Whether or not the sheriff of this county likes what I do in the privacy of my own home OR NOT, it doesn’t matter, legally anyway. I am not involved in the adult lifestyle or business and haven’t been for a couple of years now.
