Reliable Consultants, Inc. d/b/a Dreamer’s and Le Rouge Boutique operates four retail stores in Texas that carry a stock of sexual devices. They had been involved in a case in which the Texas attorney general Greg Abbott [pictured] sought enforcement of state laws that prohibit commercial sale of sexual devices.
The law was ruled unconstitutional. Then in August The Fifth U.S. Circuit Court of Appeals rejected Abbott’s request to overturn the ruling. Also involved in the case was a woman and college student, Jennifer Rasmussen, in north Texas who held ‘Tupperware-style’ parties in her home to sell vibrator and adult toys to other women.
Abbott at the time argued that it was unfair for a ‘panel’ of the New Orleans appeals court to decide the issue, and said the case may have to be decided by the U.S. Supreme Court.
But Abbott decided to drop his appeal last week having notified US District Judge Lee Yeakel of his decision. As a result, sex toys are no longer considered illegal in Texas, Mississippi and Louisiana- the three states which compromise the jurisdiction of the 5th US Circuit Court of Appeal.
