California - from www.nctimes.com - A man accused of fatally beating a transgender woman in her Oceanside home is being sued by an adult entertainment company, which claims the murder suspect illegally downloaded and shared two transgender porn movies on the Internet, federal court documents said.
Tyree Davon Paschall, 28, pleaded not guilty this week to charges of murder, fraud and petty theft. He has two prior convictions that carry strikes under the state's three-strikes law, Deputy District Attorney Terri Perez said Thursday. Paschall was on parole when the slaying occurred, Perez said.
The victim, Crain Conaway, 47, was found dead Jan. 21 in her home in the 1400 block of Marquette Street. Few details about the case have been released, except that Conaway was bludgeoned to death, Perez said.
The prosecutor said Paschall was not expected to be charged with a hate crime.
In a copyright-infringement lawsuit filed Monday in federal court, Millennium TGA Inc., a Hawaii-based corporation, is seeking $100,000 from Paschall.
"On information and belief, Mr. Paschall is the subject of an active investigation into the murder of a transgender individual," the lawsuit said.
Millennium TGA is "a prominent producer of transgender adult entertainment content," the lawsuit said.
Brett Gibbs, an attorney representing Millennium TGA, said the company has been aggressively seeking out and suing those who illegally download its content. He said thousands of others had violated the company's copyright.
Gibbs said the company's piracy investigations led to the lawsuit against Paschall, among others.
"It's just the tip of the iceberg," Gibbs said.
The lawsuit against Paschall accused of downloading two movies illegally using BitTorrent, a file-sharing program. Millennium TGA owns the copyright to both movies, the lawsuit said.
The lawsuit said Paschall downloaded the videos and, because of the way BitTorrent works, uploaded fragments of the movie files to many other users of the program in 2011 and 2012.
Gibbs said he didn't mean for his lawsuit to overshadow the tragedy of Conaway's death.
"Conaway is the true victim here," Gibbs said. "My thoughts go out to her family. Our clients are victims, also, (of) a lesser crime."
Paschall has been jailed in the Vista Detention Facility since Jan. 30 on an unrelated parole violation. Police said they had since linked him to Conaway's death and formally arrested Paschall on Monday.
A Vista Superior Court judge set Paschall's bail at $2 million on Wednesday.
